1. Agreement to Terms

By accessing, browsing, or subscribing to services provided by Encoro Technologies ("Encoro", "we", "us", or "our"), including encoro.in, associated application subdomains (such as reviews.encoro.in), contactless QR/NFC touchpoints, or APIs, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you are entering into this agreement on behalf of a company or other legal entity, you represent that you have the authority to bind such entity.

2. Description of Services

Encoro provides customer experience and engagement software, including:

• Encoro Reviews: Physical touchpoint infrastructure (NFC stands, QR displays), digital feedback routing, public Google Review redirection, and private management inboxes.
• Upcoming Ecosystem Products: Encoro Gifts (customer loyalty and appreciation mechanisms) and Encoro Menus (visual, swipe-first digital dining menus), subject to specific feature releases and tier availability.

3. Acceptable Use & Client Responsibilities

When using Encoro platforms, you agree not to:

• Fabricate deceptive reviews, impersonate consumers, or violate third-party platform terms (including Google Business Profile Review policies).
• Probe, scan, or test the vulnerability of our systems or networks, or attempt unauthorized multi-tenant access.
• Reverse engineer, decompile, or extract the source code of any Encoro software or hardware firmware.
• Deploy contactless touchpoints to distribute malicious payloads, phishing schemes, or misleading content.

4. Intellectual Property Rights

All software, visual design, user interfaces, branding, logos, trademarks, and documentation provided by Encoro remain the exclusive intellectual property of Encoro Technologies. Merchants retain full ownership of their proprietary business names, logos, venue imagery, and merchant-generated content uploaded to their accounts.

5. Service Availability & Disclaimers

We strive to deliver high-availability services. However, Encoro services are provided on an "as is" and "as available" basis. We do not guarantee uninterrupted or error-free operation, nor do we assume liability for third-party service outages (including telecommunications networks or Google Review platform API changes).

6. Limitation of Liability

To the maximum extent permitted by applicable law, Encoro Technologies and its officers, directors, and employees shall not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities arising out of or related to your use of our services.

7. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of India. Any legal action or dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the competent courts in India.
